Implementing Regulation (EU) 2019/1793 is amended as follows:
1.
in Article 1, paragraphs 3, 4 and 5 are replaced by the following:
‘3. This Regulation shall not apply to the following categories of consignments of products, unless their net weight exceeds 5 kg of fresh products or 2 kg of other products:
(a)
consignments which form part of passengers’ personal luggage and are intended for personal consumption or use;
(b)
non-commercial consignments sent to natural persons, which are not intended to be placed on the market.
This Regulation shall not apply to the following categories of consignments of products, unless their net weight exceeds 50 kg of fresh products or 10 kg of other products:
(a)
consignments sent as trade samples, laboratory samples or as display items for exhibitions, which are not intended to be placed on the market;
(b)
consignments intended for scientific purposes.
4. This Regulation shall not apply to food and feed referred to in paragraph 1, points (a) and (b) on board means of transport operating internationally, which are not unloaded and are intended for consumption by the crew and passengers.
5. In case of doubt on the intended use of the consignments of products referred to in paragraph 3, first subparagraph, the burden of proof lies with the owners of the personal luggage and with the recipients of the consignments, respectively. READ MORE

The Commission amended the 2019/1793 Enforcement Regulation (EU) with effect from 30 May 2022 on the temporary increase in official restrictions and emergency measures restricting access to certain goods from third countries to the Union.
- Due to the possibility of contamination by mycotoxins, including aflatoxin, pesticide residues, pentachlorophenol, dioxins, and microbiological contamination, special conditions were imposed for the entry into the Union of some food and feed goods.
- Article 12 of the Implementing Regulation (EU) 2019/1793 stipulates that in order to take into account new information relating to hazards to human health, the lists provided in the Supplementary Regulations should be reviewed at regular intervals of not more than six months.
- Non-compliance with union legislation, such as data resulting from notifications received through the Food and Feed ('RASFF') Rapid Alert System, as well as data on goods and information, as well as the results of documentary, identity and physical inspections, have been reported to member states by the Commission. Recent announcements by RASFF indicate that certain foods or feeds pose a serious risk to human health, either directly or indirectly.
- If certain non-animal foods and feeds do not exceed 30 kg, such goods may include trade samples, laboratory samples, exhibit items, and goods intended for scientific purposes, subject to official restrictions under the 2019/1793 Implementing Regulation.
- Goods of food and feed intended for personal consumption or consumption, which are part of the passenger's personal luggage, and non-commercial goods for food or feed sent to natural persons that are not intended to be placed on the market.
- In international passenger transport, the weight limit of 30 kg is beyond the normal luggage allowance. If 30 kg of non-commercial goods are sent to natural persons, it is difficult to ensure through official regulations that parts of such goods are not put on the market. Therefore, the weight limit of goods that are part of the passenger's personal luggage and of non-commercial goods sent to natural persons should be reduced to a level that more adequately reflects the intended personal use of the goods and the physical characteristics of the goods.
Data from RASFF notifications on rice exports from India and Pakistan, as well as information on official restrictions imposed by member countries, indicate that new risks to human health are emerging due to pollution caused by pesticide residues.
Both the RASFF report and the EU report indicate that pesticide pollution in Indian products poses a risk to human health.
Food and Feed What are the Indian product restrictions?
Rice from India (Bergera / Murraya koenigii), Okra, Moringa oleifera, Yardlong beans, Psidium guajava, Nutmeg (Myristica fragrans) The frequency and physical checks of the identity of the goods entering are set at 5 - 50.
Ethylene oxide contamination has not been detected in the roots, flowers and leaves of turmeric from India and will be exempted from increased official restrictions. At the control posts, only dry spices from India will be subject to official restrictions.
