Justice Shekhar Kumar Yadav of the Allahabad High Court met with the Supreme Court Collegium on Tuesday, following media reports of his alleged communal remarks made during a Vishwa Hindu Parishad (VHP) event. These remarks have sparked significant political backlash, with Opposition MPs moving an impeachment motion in the Rajya Sabha.
The meeting provided an opportunity for Justice Yadav to address the allegations regarding his comments, which were reported to have been made at the December 8 event.
Supreme Court Takes Note of Media Reports
On December 10, the Supreme Court issued a statement acknowledging the media reports and confirming that it had sought details from the Allahabad High Court. The court assured that the matter was "under consideration."
The remarks in question have drawn sharp criticism. The All India Lawyers Union wrote to Chief Justice of India Sanjiv Khanna, expressing concern that Justice Yadav’s statements indicated a shift away from democratic values toward a "Hindutva Rashtra." Similarly, the Campaign for Judicial Accountability and Reforms, led by advocate Prashant Bhushan, accused Justice Yadav of violating his judicial oath by participating in a “right-wing event” and making communally charged comments.
Political and Legal Outrage
CPI(M) leader Brinda Karat also addressed the Chief Justice, asserting that the judge’s statements were a clear violation of his constitutional duty and calling for his removal from judicial responsibilities.
The controversy underscores concerns about the perceived neutrality of the judiciary, with critics emphasizing the importance of maintaining public trust in judicial institutions. The Collegium’s engagement with Justice Yadav is seen as a critical step in addressing the situation and upholding the judiciary’s integrity.
