A bench comprising Justices Surya Kant and Joymalya Bagchi rejected the Election Commission of India’s (ECI) objections to formally including Aadhaar among the list of approved identity documents. The court observed that while Aadhaar cannot serve as proof of citizenship, it remains a valid and widely accepted indicator of identity and residence.
The case arises from challenges to the ECI’s Special Intensive Revision (SIR) exercise, which opposition parties allege has led to the arbitrary deletion of genuine voters’ names without proper verification.
Opposition leaders have argued that the SIR drive amounts to an “unfair clean-up,” pointing out that Aadhaar—a document held by the vast majority of citizens—was excluded from the 11 accepted documents required to add names to the electoral rolls.
On August 18, the ECI published the names of 6.5 million voters who had been removed from the draft rolls as part of the SIR process, intensifying concerns over potential disenfranchisement ahead of the upcoming elections.
