Nashik/Mumbai: Nida Khan, the absconding HR manager accused in the alleged religious coercion and sexual harassment case at Tata Consultancy Services (TCS) Nashik unit, is preparing to file a petition seeking anticipatory bail, with pregnancy expected to be a central ground in her plea.
Sources indicate that the bail application is currently being processed and is likely to be submitted shortly. Khan, 26, who relocated to Mumbai following her marriage last year, had reportedly secured a transfer to the company’s Mumbai office in January. She is understood to be in the early stages of pregnancy, a factor her legal team is expected to highlight prominently before the court.
Prosecutors, however, are likely to oppose the plea, maintaining that Khan played a significant role in the alleged offences. Investigating authorities have described her as a “key conspirator,” alleging her active involvement in grooming and coercing victims into religious practices.
Case Background
The controversy centres around serious allegations emerging from TCS’s Nashik BPO facility, where multiple employees have been accused of sexual exploitation, harassment, and religious coercion. The case has drawn widespread attention, raising concerns over workplace safety and corporate oversight.
The matter came to light after a 23-year-old employee lodged a complaint with Nashik Police, accusing her senior colleague Danish Shaikh of establishing a sexual relationship under the false promise of marriage.
The FIR has been registered under several provisions of the Bharatiya Nyaya Sanhita, including Section 69 (sexual intercourse obtained through a false promise of marriage), Section 75 (sexual harassment), and Section 299 (acts intended to insult religious beliefs).
According to the complainant, Danish Shaikh, along with another accused, Tausif Attar, allegedly attempted to influence her religious beliefs, advocating Islam over Hinduism. She further alleged that Attar, in conjunction with Khan, made objectionable remarks regarding a Hindu deity.
Investigators have also received complaints suggesting that the accused operated in a coordinated manner, allegedly targeting young women employees, primarily in the 18–25 age group.
So far, eight individuals — including Danish Shaikh, Tausif Attar, Raza Memon, Shahrukh Qureshi, Shafi Sheikh, Asif Aftab Ansar, and Shahrukh Sheikh, along with a female accused — have been arrested. Khan remains the only accused yet to be taken into custody.
The case continues to unfold, with legal proceedings expected to intensify in the coming days.
