The Supreme Court has ruled that no criminal action should be taken against sex workers and that it is a dignified occupation. A three-judge bench headed by Justice L Nageshwara Rao passed the order. The court issued six directives on the rights of sex workers. The bench clarified that sex workers are also entitled to equal protection under the law. Criminal law should apply equally in all cases on the basis of age and consent.
The Supreme Court has also ruled that a child should not be separated from his mother on the grounds that he is involved in the sex trade. The court ruled that the basic protection of a man's dignity and honor applies to sex workers and their children. At the same time, the court found that running a brothel was illegal.
The police have no authority to intervene if it is clear that the sex worker is an adult and participates with consent. The Supreme Court has directed that they should not be harassed and criminal cases should not be filed against them.
