President-elect Donald Trump is scheduled for sentencing on January 10, just 10 days before his inauguration, in a case involving hush money payments to adult film actor Stormy Daniels. Justice Juan Merchan, presiding over the matter, stated on Friday that Trump is unlikely to face incarceration or other penalties. Instead, the judge suggested an "unconditional discharge," meaning no jail time, fines, or probation—a decision that would allow Trump to appeal the verdict.


Unprecedented Legal Proceedings

This marks a historic first for the United States, as no sitting or former president has been criminally charged or convicted before. Justice Merchan’s ruling requires Trump, 78, to attend the sentencing, either in person or virtually.

Rejecting Trump’s motion to dismiss the case following his presidential election victory, Merchan emphasized the importance of upholding the rule of law. "Setting aside the jury's verdict would undermine the rule of law in immeasurable ways," Merchan wrote, dismissing arguments that the case could hinder Trump’s ability to govern.

The case stems from a $130,000 payment made by Trump’s former lawyer, Michael Cohen, to Stormy Daniels in the lead-up to the 2016 election to suppress allegations of an affair—a claim Trump denies. In May, a Manhattan jury convicted Trump on 34 counts of falsifying business records to conceal the payment.

Trump, who pleaded not guilty, characterized the prosecution as a politically motivated attack by Manhattan District Attorney Alvin Bragg, a Democrat, aimed at derailing his 2024 presidential campaign.

Justice Merchan cited Trump’s repeated public attacks on the judiciary and the legal system during the trial as factors influencing his decision. “Defendant’s unrelenting and unsubstantiated attacks against the integrity of the criminal proceeding do not weigh in his favor,” Merchan noted.

While Merchan acknowledged the unique circumstances, he found delaying sentencing until after Trump’s presidency less favorable than resolving it before the inauguration.
