Court Lists Defamation Complaint Against Former Delhi CM Atishi, AAP MP Sanjay Singh for Order on Cognizance

New Delhi [India], March 22: The Rouse Avenue Court has scheduled the defamation complaint against former Delhi Chief Minister Atishi and Aam Aadmi Party (AAP) MP Sanjay Singh for an order on cognizance. The complaint was filed by former Congress MP Sandeep Dikshit, who has accused the AAP leaders of making defamatory statements against him and the Indian National Congress (INC) during a press conference on December 26, 2024.

According to the complaint, Atishi and Sanjay Singh falsely alleged that Dikshit and the INC had accepted "crores of rupees" from the Bharatiya Janata Party (BJP) and had colluded with the BJP with the objective of defeating AAP in the Delhi elections. The complainant asserts that these allegations were made without any supporting evidence and were intended to tarnish his reputation.

Following pre-summoning submissions from both parties, Additional Chief Judicial Magistrate (ACJM) Paras Dalal has scheduled the matter for clarification and order on April 3, 2025. The court had earlier issued notices to Atishi and Sanjay Singh on January 16, allowing them an opportunity to be heard before cognizance of the complaint was taken.

The complaint further highlights that Atishi, in the presence of and with the concurrence of Sanjay Singh, accused the INC and Dikshit of working in tandem with the BJP. It also states that the live press conference was shared by Atishi on her official X handle (formerly Twitter) with the caption: "BJP is helping Congress in the Delhi election." The post reportedly garnered over 30,000 views and was widely circulated. Additionally, several national newspapers covered the alleged defamatory statements.

Dikshit, represented by advocate Sarim Naved, contends that the statements made during the press conference and their subsequent dissemination on social media were deliberate attempts to harm his reputation. The complaint alleges that these actions constitute defamation under Section 356 of the Bharatiya Nyaya Sanhita (BNS), 2023.

A legal notice was sent to the accused on January 2, yet the alleged defamatory post remains accessible online. The case now awaits the court's decision on whether to proceed with cognizance of the complaint.
