In a significant political and legal development, a Special Court for MPs and MLAs in Bengaluru has sentenced Congress MLA Vinay Kulkarni and 16 other accused to life imprisonment in connection with the murder of BJP Zilla Panchayat member Yogesh Gowda.
The court convicted the accused on charges of murder and criminal conspiracy, awarding life imprisonment as the principal sentence. In addition, the court imposed a seven-year term for destruction of evidence, though the life sentence will prevail as the highest punishment.
Premeditated Killing, Court Finds
The verdict follows an earlier conviction, with the court concluding that the हत्या was part of a premeditated and organised conspiracy aimed at eliminating the BJP leader.
The case dates back to June 15, 2016, when Yogesh Gowda was hacked to death inside a gym in Dharwad—an incident that sent shockwaves through the state’s political landscape.
CBI Probe and Lengthy Trial
Given the sensitivity of the case and allegations of political involvement, the investigation was later handed over to the Central Bureau of Investigation (CBI).
The agency filed a chargesheet against 21 individuals, citing political rivalry and local disputes as key motives behind the crime. Over the course of the trial, more than 100 witnesses were examined, with two accused turning approvers and playing a crucial role in the prosecution’s case.
Political Implications for Sitting MLA
The sentencing of a sitting legislator carries significant political ramifications. Under existing legal provisions, Vinay Kulkarni now faces the prospect of disqualification from the Karnataka Legislative Assembly.
Legal experts note that he must obtain a stay on his conviction from either the High Court or the Supreme Court within a stipulated timeframe to avoid disqualification proceedings.
