Disciplinary Hearing Against Enoch Burke to Proceed Despite Failed Injunction Bid

A disciplinary hearing concerning the dismissal of Enoch Burke is set to proceed on Friday, despite his attempt to secure a High Court injunction to halt the process.

The Disciplinary Appeals Panel (DAP) is scheduled to convene at 10 a.m. However, Mr Burke argued that the hearing should be deferred pending a ruling from the Court of Appeal in a related case involving his dispute with Wilson’s Hospital School.

On Thursday evening, Mr Justice Micheal O’Connell of the High Court رفض (refused) the injunction application after proceedings extended late into the evening. The court also granted a production order to ensure Mr Burke’s attendance at the disciplinary hearing.

Mr Burke has consistently maintained that the directives issued by the school were unconstitutional and infringed upon his right to express his religious beliefs. His case has drawn considerable attention, particularly as he has spent over 650 days in prison for breaching court orders prohibiting him from attending the school premises.

Earlier this week, the Court of Appeal heard Mr Burke’s appeal against a May 2023 ruling by Mr Justice Alexander Owens, which upheld the lawfulness of his suspension. Mr Burke acknowledged that his appeal was filed outside the standard 28-day window, citing ongoing litigation, periods of imprisonment, and a loss of confidence in the appellate process.

He argued that the earlier judgment failed to adequately consider his constitutional rights and did not properly examine the legality of the school principal’s instructions. He also referenced a statement by the Department of Education suggesting that schools are not legally obligated to use students’ preferred pronouns, though this position was challenged as non-binding by legal counsel for the school.

Representing the school’s board, lawyer Rosemary Mallon described the delay in filing the appeal as “extraordinary” and stressed the necessity for finality in the proceedings. She further clarified that the original ruling addressed the legality of the suspension decision, rather than the broader question of the principal’s directive.

During Thursday’s proceedings, Mr Justice Brian Cregan recused himself from hearing the injunction application after Mr Burke raised concerns of potential bias, citing previous judicial remarks. While rejecting the allegation, Justice Cregan stated that it was important not only for justice to be done, but to be seen to be done.

Mr Burke contended that the issues before the DAP are fundamentally legal and constitutional in nature, arguing that such matters should be determined exclusively by the courts rather than a disciplinary panel. He maintained that the legitimacy of the principal’s instructions remains central to both the disciplinary process and his appeal.

Counsel for the DAP, Padraic Lyons SC, dismissed Mr Burke’s arguments as “untenable” and “misconceived,” asserting that the panel’s proceedings would not preclude further legal recourse. He emphasized that any decision by the DAP could be subject to judicial review if necessary.

In his ruling, Justice O’Connell concluded that the prior judgment did not constitute a final determination on the validity of the principal’s instruction and found no basis to delay the disciplinary hearing pending the appeal outcome.

Mr Burke’s long-running dispute with the Co. Westmeath school dates back to 2022, arising from his refusal to comply with a request to address a student by a new name and pronoun. He was subsequently suspended and later dismissed.

The current Disciplinary Appeals Panel—its third iteration—comprises Claire Callanan, John Irwin, and Seamus Lahart. The case continues to attract significant legal and public interest as it navigates complex intersections of employment law, constitutional rights, and educational policy.
