Allahabad High Court Seeks Review of POCSO Law

NEW DELHI — The Allahabad High Court has asked the Law Commission of India to examine whether changes are needed to the Protection of Children from Sexual Offences (POCSO) Act, 2012, particularly in cases involving relationships between minors.

The court said the law should be reviewed in light of changing social realities and the circumstances of individual cases. It noted that applying the Act strictly in every situation could, in some cases, lead to outcomes that do not serve the interests of justice, including cases in which a child is born from a relationship between minors.

The court also suggested that alternative punishments, such as community service, could be examined in appropriate cases. The observations do not mean that the law has been amended. Any changes would require further consideration and the relevant legal process.

The issue concerns how the law can continue to protect children from sexual offences while addressing the specific circumstances of cases involving minors.
