Delhi Police has registered an FIR against Chief Minister Atishi for allegedly violating the Model Code of Conduct (MCC) by using a government vehicle for political purposes. The FIR, lodged at the Govindpuri police station in southeast Delhi, was based on a complaint filed by the returning officer of the Kalkaji assembly constituency.
Details of the FIR
The FIR, filed on Saturday, cites the alleged use of a Public Works Department (PWD) vehicle belonging to the Delhi government for election-related activities. This violates the MCC, which imposes a strict ban on the use of official vehicles for campaigning during elections.
A senior police officer stated, “A case has been registered under Section 223(a) of the Bhartiya Nyay Sanhita (BNS), which pertains to disobedience to orders from a public servant. Depending on the nature of the disobedience, penalties range from six months’ imprisonment and a fine of ₹2,500 to one year in jail and a fine of ₹5,000 if the disobedience poses threats to human life, safety, or public order.”
AAP’s Response: Allegations of Bias
The Aam Aadmi Party (AAP) strongly criticized the FIR, accusing the authorities of acting under pressure from the BJP. AAP Chief Arvind Kejriwal took to social media, stating, “Their leaders openly distribute money, sarees, blankets, gold chains, and make fake votes, yet no FIR is registered. But an FIR is immediately filed against Chief Minister Atishi. AAP is fighting against a corrupt system that BJP and Congress are both part of.”
AAP Rajya Sabha MP Sanjay Singh echoed Kejriwal’s sentiments, accusing the Election Commission and Delhi Police of partiality. “We have submitted complaints against BJP leaders with video evidence, but no action is ever taken. The system must act impartially to let the truth prevail,” he said.
BJP’s Allegations
On January 8, the BJP submitted a formal complaint to the Chief Electoral Officer of Delhi, accompanied by a video clip. BJP spokesperson Praveen Shankar Kapoor stated that the video, provided by South Delhi BJP Vice President Sardar KS Duggal, shows the chief minister allegedly misusing a PWD vehicle to transport election material. Kapoor urged the Election Commission to take cognizance of the matter and initiate appropriate action.
Awaiting BJP’s Response
While BJP leaders have yet to respond directly to AAP’s allegations of bias, the party previously highlighted the misuse of government resources as a serious breach of election norms. The BJP claims that such violations undermine the integrity of the electoral process and called for stringent enforcement of MCC guidelines.
