ED Secures Nod to Prosecute Arvind Kejriwal, Manish Sisodia in Delhi Excise Policy Case

The Enforcement Directorate (ED) has received the Ministry of Home Affairs' (MHA) sanction to prosecute Aam Aadmi Party (AAP) leader Arvind Kejriwal and former Delhi Deputy Chief Minister Manish Sisodia in connection with the money laundering case related to the scrapped Delhi excise policy.

This decision comes after Delhi Lieutenant Governor VK Saxena granted approval for prosecuting the former Chief Minister. The development paves the way for the ED to formally frame charges against Kejriwal and Sisodia, presenting new challenges for the AAP leadership ahead of the Delhi Assembly elections scheduled for February 5.

Supreme Court’s Ruling and AAP’s Counteraction
The Supreme Court, in a ruling last November, mandated that the ED must obtain prior sanction before initiating prosecution against public servants. Following this directive, the ED sought approval from the Lieutenant Governor, asserting that Kejriwal was the "kingpin and key conspirator" in the alleged scam.

In response to the prosecution efforts, Arvind Kejriwal approached the Delhi High Court, contending that the chargesheet filed by the ED against him and others was invalid due to the absence of prior approval from the appropriate authorities before filing the prosecution complaint.

Implications Ahead
If charges are formally framed, trials could soon commence, potentially impacting Kejriwal’s political prospects and complicating his potential return as Delhi's Chief Minister. The ongoing legal battle further intensifies the spotlight on the Delhi excise policy controversy as the Assembly elections draw near.
