Congress to Challenge Constitutionality of Waqf Amendment Bill in Supreme Court

The Indian National Congress on Friday announced its intention to challenge the constitutional validity of the Waqf (Amendment) Bill, recently passed by both Houses of Parliament.

Taking to X (formerly Twitter), senior Congress leader Jairam Ramesh described the Bill’s passage as “an assault of the Narendra Modi government on the Indian Constitution.” He further stated that the party would pursue legal recourse to contest the legislation, adding that the Congress remains steadfast in its efforts to defend constitutional values.

“The INC’s challenge of the CAA, 2019 is being heard in the Supreme Court. The INC’s challenge of the 2019 amendments to the RTI Act, 2005 is being heard in the Supreme Court,” Ramesh wrote.

He continued, “The INC’s challenge to the validity of the amendments to the Conduct of Election Rules (2024) is being heard in the Supreme Court. The INC’s intervention to uphold the letter and spirit of the Places of Worship Act, 1991 is being heard in the Supreme Court.”

Emphasizing the party’s consistent legal strategy, Ramesh confirmed: “The INC will very soon be challenging in the Supreme Court the constitutionality of the Wakf (Amendment) Bill, 2024.”

“We are confident and will continue to resist all assaults of the Modi Govt on the principles, provisions, and practices that are contained in the Constitution of India,” he concluded.

The Waqf (Amendment) Bill, 2025—touted by the ruling NDA government as a major legislative reform—has drawn criticism from opposition parties, who allege it undermines key constitutional safeguards and minority rights. With legal challenges already pending on multiple legislative actions of the Modi government, the Congress party's decision to approach the Supreme Court marks yet another front in its ongoing confrontation with the ruling dispensation.
