Central Criminal Court Hears Allegations of Childhood Sexual Assault and Rape

 In a trial at the Central Criminal Court, a woman has alleged that she was subjected to sexual assault by her mother and rape by her uncle and a family friend during her childhood. The incidents are said to have occurred between 2000 and 2014, primarily at the family home within the State.


The complainant’s mother, uncle, and a third man face a combined total of 21 charges of sexual assault and rape. The defendants, whose identities are protected for legal reasons, have pleaded not guilty to all charges.

Complainant’s Testimony

During proceedings on Thursday, the complainant, testifying before Anne Marie Lawlor SC for the prosecution, described her early childhood living with her mother, uncle, and three other adult relatives in a household marked by heavy alcohol consumption and volatility. She recounted frequent physical altercations and verbal abuse, noting that her mother, who struggled with alcohol dependency, was often “vicious” and physically aggressive.

The complainant alleged that her mother first sexually assaulted her at the age of three and a half, instructing her to perform a sexual act and to keep it a secret. The mother, now in her 50s, faces 13 counts of sexual assault and one count of facilitating the rape of her daughter by her brother. The complainant detailed further alleged assaults by her mother, including incidents during a family holiday when she was four, which she described as painful and confusing.

The complainant stated that the abuse by her mother ceased when she began menstruating at age 12, though she recalled a later incident at 15 where she pretended to be asleep to stop an assault. She testified to multiple instances of rape and oral rape by her uncle, now in his 40s, beginning when she was five and a half. She described one incident where her mother was present in the room and another where she suffered severe bleeding at age 12, which she believed was a miscarriage resulting from her uncle’s actions.

The third defendant, a man in his 50s and a friend of the complainant’s mother’s partner at the time, is accused of one count of oral rape when the complainant was 13. She alleged that he locked the door of a room where she was playing a video game and assaulted her, claiming her mother was aware of his actions.

Household Environment and Aftermath

The complainant described a chaotic home environment, with alcohol misuse and neglect prompting involvement from Tusla, the child and family agency. She made an initial statement to Gardaí at 17 but did not disclose the alleged sexual abuse, citing fear and suppression of the memories. Years later, after moving to another part of the country and receiving support from a rape crisis centre, she reported the allegations to authorities.

Under cross-examination by Desmond Dockery SC, representing the complainant’s mother, the witness affirmed her recollection of the initial assault at age three and a half, rejecting suggestions that her use of terms like “feel” and “believe” undermined her account. She acknowledged limited memory of specific details surrounding the incidents, such as their duration or exact circumstances.

Ongoing Proceedings

The trial, presided over by Ms Justice Eileen Creedon and a jury, continues at the Central Criminal Court. The defendants maintain their not guilty pleas, and further evidence is expected to be presented.
