New Delhi, August 25 — Amid intense opposition uproar over the 130th Constitutional Amendment Bill, Union Home Minister Amit Shah on Monday asserted that it was Prime Minister Narendra Modi himself who insisted on bringing the office of the Prime Minister under the ambit of the proposed legislation.
Introducing the Bill during the recently concluded Monsoon Session of Parliament, Shah clarified that the amendment seeks to mandate the removal of the Prime Minister, Chief Ministers, and Ministers from office if they are jailed for more than 30 days in cases involving serious offences.
“The Prime Minister himself has included the post of PM in this. Earlier, Indira Gandhi had brought the 39th Amendment, which shielded the President, Vice President, Prime Minister, and Speaker from judicial review by Indian courts. In contrast, Narendra Modi ji has brought a constitutional amendment against himself—stating clearly that if the Prime Minister goes to jail, he will have to resign,” Shah said.
The Bill has sparked fierce debate in both Houses, with opposition parties accusing the government of political posturing, while the ruling party has projected it as a bold step towards accountability and transparency in governance.
If passed, the 130th Amendment would mark a significant shift in India’s constitutional framework by explicitly placing the highest executive offices under stricter legal scrutiny
