Madrid: The coalition government of Spanish Prime Minister Pedro Sanchez intends to pass a bill legalizing abortion for children between the ages of 16 and 17 without parental consent. Last month, the Spanish Penal Code was amended to make it a criminal offense to "torture" women entering abortion clinics.
Sources in the Ministry of Equality confirmed on May 17 that this was the final stage of discussions in the government formed by the Spanish Socialist Workers' Party and Unidas Podemos, and that the Council of Ministers was expected to approve it. The bill will be introduced in the Congress of Deputies after the approval of the Cabinet.
The draft bill eliminates the three-day waiting period prior to an abortion, during which the mother is notified of maternity and abortion rights, benefits, and public assistance.
This would control the conscientious objection of health workers, create a register of conscientious objectors, strengthen the right to abortion in public health centers, and make abortion in a private clinic a second choice.
In addition, the bill would reduce or eliminate the value-added tax on female hygiene products, offer free items in schools and prisons, provide extended maternity leave before childbirth, and allow medical leave for women with severe menstrual pain.
Abortion has been legal in Spain since 1985. The current abortion law, which requires parental consent to perform abortions on 16- and 17-year-old girls, was passed in 2015 when the People's Party was in power. The People's Party is now the largest group in the opposition. In October 2020, Equality Minister Irene Montero said the repeal of the Parental Consent Act was "too much".
At the Council of Ministers at the time, Montero said, "Like many [abortion advocates] from all over the world, we demand that all women have the right to decide their own bodies, and that we demand a" complete and free sex life "and free motherhood in July 2021." It's not just about rights, "Montero declared.
Women in Spain can get state-paid abortion on demand during the first 14 weeks of pregnancy, up to 22 weeks in cases of serious health risks to the mother or baby, and for all nine months if the fetus has anomalies incompatible with life, or an extremely serious and incurable disease.
