The reference to the criminal defamation case was made in an election speech in Kolar, Karnataka. BJP MLA Purnesh Modi filed a complaint against Rahul in the Surat Metropolitan Magistrate Court. After Rahul was sentenced to two years in prison in the case, he was disqualified from the post of MP.
Purnesh Modi filed an affidavit in the Supreme Court demanding that Rahul's appeal be dismissed. The complainant alleged that Rahul Gandhi has a history of committing such crimes.
However, Rahul replied that all such complaints were lodged by his political opponents and he was not punished for any of them. After his conviction in the case, the Lok Sabha Secretariat disqualified him. The Surat court in Gujarat sentenced Rahul to two years in the case.
The court gave Rahul the maximum sentence that can be given in a defamation case. Under the Representation of the People Act, imprisonment for two years or more will result in disqualification. On the basis of this, Rahul was disqualified as Lok Sabha Secretariat.
MP The Lok Sabha Housing Committee had asked Rahul to vacate his official residence at Tughlaq Lane 12 following his disqualification from the post. There was also a lot of criticism against the Center, pointing out the haste in taking steps, including the request to vacate the residence that he has been using since he became a member of the Lok Sabha in 2004.
