Baramulla MP Sheikh Abdul Rashid Seeks Bail in 2017 Terror-Funding Case

New Delhi [India], January 22 (ANI): Baramulla MP Sheikh Abdul Rashid has moved the Delhi High Court with a bail application under the Unlawful Activities (Prevention) Act (UAPA) in connection with the 2017 terror-funding case. Rashid’s legal counsel has urged the High Court to direct the trial court to expedite its decision on his pending bail plea. Alternatively, they have requested the High Court to adjudicate and rule on the matter directly.The Delhi High Court is scheduled to hear the case tomorrow.


Previous Developments

Delhi’s Patiala House Court recently dismissed a request to decide on Rashid’s regular bail application, stating that its jurisdiction is currently limited to miscellaneous matters. The court clarified that jurisdictional issues are still pending before the Delhi High Court.

Earlier, the district judge returned the case to the Additional Sessions Judge (ASJ) court, following a request to transfer the matter to a designated court for lawmakers. This request was consented to by both Rashid and the National Investigation Agency (NIA). Meanwhile, the ASJ court continues to handle the case until the High Court resolves the jurisdictional dispute.

Background of the Case

Rashid, an independent Lok Sabha MP from Baramulla, was arrested in August 2019 under the UAPA in connection with the NIA’s investigation into terror-funding activities in Jammu and Kashmir. Despite his incarceration, he contested and won the 2024 parliamentary elections from jail, defeating former J&K Chief Minister Omar Abdullah by a significant margin.

In 2022, the Patiala House Court framed charges against Rashid and several prominent figures, including Hafiz Saeed, Syed Salahuddin, Yasin Malik, and others, alleging their involvement in funding terrorism in Jammu and Kashmir. The NIA claims that militant organizations such as Lashkar-e-Taiba, Hizbul Mujahideen, and Jaish-e-Mohammed, along with Pakistan's ISI, orchestrated violence in the region using funds channeled through illicit means.

The investigation further alleges that the All Party Hurriyat Conference (APHC) played a pivotal role in promoting separatist activities, leveraging hawala networks and covert funding to incite unrest, target security forces, and damage public infrastructure in Jammu and Kashmir.

The case remains a significant development in the ongoing counter-terrorism efforts in the region.
