New Delhi, February 12 – The Saket District Court in Delhi has rejected the bail plea of an Afghan national, Omid Nazari, accused in a robbery case involving grievous injuries to the victim. The case was registered at Malviya Nagar police station, and the court dismissed the application after reviewing key evidence, including the victim’s medical examination report (MLC).
Court’s Rationale for Bail Rejection
Presiding over the case, Additional Sessions Judge (ASJ) Neha emphasized the seriousness of the charges and upheld established legal precedents governing non-bailable offenses.
"The law regarding bail has been well established through various judgments of the Supreme Court and High Court, as cited by the defense counsel in the present application. In non-bailable offenses, the discretion to grant bail lies with the court, depending on the facts and circumstances of the case," the judge stated.
"In this instance, given the serious nature of the allegations, the court is not inclined to grant bail to the accused, Omid Nazari. The bail application is, therefore, dismissed," the order, dated February 4, read.
Medical Evidence and Victim's Injuries
A key factor in the court’s decision was the victim’s medical examination report (MLC), which confirmed multiple injuries. The victim sustained a bruise on the forehead, a laceration on the inner lip, and an abrasion on the left elbow. Additionally, medical reports confirmed a fracture in one of his fingers, further substantiating the severity of the assault. The court observed that the accused, along with a co-accused, had physically attacked and robbed the victim, inflicting grievous injuries, which played a crucial role in the denial of bail.
Case Background
According to the charge sheet filed by Delhi Police, the incident occurred on October 20, 2024, at approximately 3 AM. The complainant was riding his scooter to a nearby medical store when he was confronted by two Afghan nationals who obstructed his path.
When the complainant objected, the accused began verbally abusing him. As bystanders passed through, the assailants initially retreated but later returned once the street was deserted. They attacked the victim, attempting to forcefully remove a gold ring from his finger. Upon resistance, they severely assaulted him and stole his wallet, which contained ₹8,000 in cash, a driving license, and an Aadhaar card.
Defense’s Argument and Court’s Response
The defense counsel argued that the complainant’s version was fabricated, questioning why he was out at 3 AM when a medical store was available nearby. Additionally, they contended that the accused and co-accused, who earned their livelihood from a shop that had been shut for two months, were falsely implicated.
However, the court, considering the gravity of the crime and the medical evidence, found no merit in these arguments and ruled against granting bail.
Judicial Custody Continues
The accused has been in judicial custody for over 75 days, and the court’s decision reaffirms a strict stance against violent crimes involving assault and robbery. With the charge sheet already filed, further proceedings in the case will continue as per legal directives.
