The Supreme Court on Monday sharply criticised petitioners seeking the registration of an FIR against Assam Chief Minister Himanta Biswa Sarma over a viral video allegedly showing him aiming and firing a rifle at members of a particular community. The Court cautioned litigants against undermining constitutional institutions in politically sensitive matters.
A bench comprising Chief Justice of India Surya Kant and Justice Joymalya Bagchi observed what it described as a “disturbing trend,” remarking that the apex court increasingly becomes a “political battleground” whenever elections are underway in a state.
Declining to entertain the petition directly, the bench directed the petitioners to approach the Gauhati High Court. “Please come to us via the constitutionally prescribed route,” the Court stated, emphasising adherence to judicial hierarchy and procedural norms.
Allegations in the Plea
The petition alleged that the Chief Minister had, on multiple occasions, made remarks inciting discrimination, social and economic boycott, and violence against Bengali-origin Muslims in Assam. It further claimed that his public speeches and media interactions promoted enmity and hatred on grounds of religion, language, place of birth and residence.
According to the plea, the Chief Minister allegedly used terms such as “Miya” and “Bangladeshi” in reference to Bengali-origin Muslims, which the petitioners argued contributed to communal polarisation.
The Court, however, refrained from expressing any view on the merits of the allegations, limiting its observations to procedural propriety and directing the matter to the appropriate forum for adjudication.
