Demolition of Unauthorised Meath Property Proceeds After Two-Decade Legal Battle

Ireland: The demolition of a large unauthorised residence in County Meath is now underway, bringing to a close a protracted legal dispute spanning nearly two decades.

The property, a 6,220 sq ft (588 sq m) house located at Faughan Hill, Bohermeen, near Navan, was constructed in 2006 by Chris and Rose Murray despite being refused planning permission by Meath County Council. The case has since become one of Ireland’s most prominent planning enforcement disputes.

On Thursday, the High Court reaffirmed that existing demolition orders remain enforceable. Presiding Judge Richard Humphreys declined an application by the homeowners’ legal representative, solicitor Neil McNelis, to suspend the demolition pending the outcome of proceedings before the European Court of Human Rights. The application alleges breaches of the couple’s human rights.

In his ruling, Judge Humphreys stated that the enforcement of domestic court orders does not impede the applicants’ right to pursue remedies at a European level.

Demolition Process Underway

Court proceedings confirmed that demolition had already commenced, with preparatory works carried out on-site. A convoy of security and support vehicles arrived at the rural property to disconnect utilities and assess the structure. While heavy machinery had yet to be deployed, activity including the sound of breaking glass indicated that dismantling efforts were in progress.

The demolition follows High Court orders issued earlier in the week, marking the culmination of years of litigation, including multiple planning refusals and unsuccessful appeals.

Family’s Final Legal Effort

The Murrays’ legal team sought a temporary halt to the demolition, arguing that such action was premature while their case is under consideration by the European Court of Human Rights. However, the court found no legal basis to delay enforcement.

The dispute dates back to 2006, when a planning application submitted by Mr. Murray was refused. Despite this, the house—reportedly significantly larger than the original proposal—was constructed. Over the years, the family submitted several retention applications and proposals to modify or reduce the structure, all of which were rejected.

In a 2025 judgment, the Court of Appeal dismissed the family’s latest challenge, observing that the applicants were fully aware that planning permission was required but proceeded regardless.

Emotional Toll on Family

Speaking from outside the jurisdiction due to an outstanding arrest warrant related to contempt of court, Rose Murray described the eviction and demolition as deeply distressing.

She stated that the family, including their three adult children, were forced to vacate the property under court orders earlier this week, with limited time to retrieve personal belongings.

“We could have been left with nothing,” she said, describing the rushed efforts to clear the home. Community members assisted in removing possessions in what she characterised as a chaotic but supportive response.

Ms. Murray, who recently recovered from breast cancer, also expressed frustration over being unable to access essential items during the eviction process.

While acknowledging that constructing the house without permission was a mistake, she maintained that the family had made repeated efforts over the years to regularise the situation.

Calls for Alternative Use

Amid Ireland’s ongoing housing challenges, Ms. Murray suggested that the property could have been repurposed rather than demolished.

“It could have been donated to a housing charity,” she said, expressing regret that the structure would instead be reduced to rubble.

Meath County Council reiterated that it is legally obligated to enforce court orders, noting that its position has been consistently upheld across multiple judicial rulings over an extended period.
