Supreme Court May Form Special Bench to Hear Pinarayi Vijayan’s Plea

NEW DELHI — The Supreme Court of India has indicated that it may constitute a special bench during the Dussehra vacation to hear a plea by former Kerala Chief Minister Pinarayi Vijayan seeking protection from arrest and other coercive action in a case linked to alleged financial dealings between Cochin Minerals and Rutile Limited (CMRL) and Exalogic Solutions.

Senior advocate Sidharth Luthra sought an urgent hearing before Chief Justice of India Surya Kant on Friday, citing concerns about Vijayan’s personal liberty and the possibility of arrest.

The Chief Justice initially indicated that the matter could be listed after the court reopened on October 26. After the lawyer pressed for an earlier hearing, the Chief Justice said the court could consider setting up a special bench during the vacation.

No special bench or final order had been announced at the time of the report.

The plea challenges a Kerala High Court decision upholding an order directing the registration of first information reports in connection with alleged payments made by CMRL and an associated concern to Exalogic, a company formerly run by Vijayan’s daughter, Veena T.

The High Court dismissed separate appeals filed by Vijayan, Veena T and former minister P. A. Mohamed Riyas on Thursday. It held that a person accused in a corruption case has no legal right to be heard before an FIR is registered, while clarifying that other legal remedies remain available.

The allegations are subject to investigation and judicial scrutiny. They have not been established as proven offences.
