BENGALURU — The Karnataka High Court has struck down provisions of a state law that increased reservations for Scheduled Castes (SCs) and Scheduled Tribes (STs), ruling that the changes breached the 50 per cent ceiling on total reservations.
A division bench led by Chief Justice Vibhu Bakhru and Justice K. S. Hemalekha ruled against the provisions of the 2022 Karnataka law that raised the SC quota from 15 per cent to 17 per cent and the ST quota from 3 per cent to 7 per cent.
The increase took the total reservation in the state to 56 per cent, including the 32 per cent quota for Other Backward Classes. The court held that the enhanced quotas exceeded the permissible limit and violated constitutional provisions relating to equality.
The state government had argued that reservations should reflect the population of the communities concerned. However, the court did not accept the argument as sufficient grounds to exceed the 50 per cent ceiling.
The Karnataka government has indicated that it will explore legal options, including an appeal before the Supreme Court. The ruling is expected to renew debate over reservation limits and the legal requirements for expanding quotas.
