Can penalty points or a fixed charge be cancelled ?
If you have been given penalty points in driving (or a fixed charge without penalty points) can apply to the Gardai to cancel the points. You need to show that there are good procedural or extraordinary reasons for the cancellation.
Procedures – Examples of this include:
🔘A technical problem means that incorrect information has been entered (for example, the wrong speed limit has been detected).
🔘You are exempt from the seat belt charges, for example, You have an exemption from wearing a seat belt.
Exemptions from the requirement to wear a seat belt: You do not have to wear a seat belt if:
- Wearing a handicap belt.
- If you hold a medical certificate signed by a qualified medical practitioner stating that you are medically inadvisable to wear a seat belt or child restraint
- Teaching someone else how to drive (although going without a seat belt is not recommended)
- A driving test examiner conducts the driving test.
- Are a member of the Garda or Defence Forces and drive as part of your duties.
- Drivers of small public service vehicles (such as taxis) are not exempt, and seat belts must be worn when driving these vehicles.

🔘You have been fined for having no tax or insurance but can show you had motor tax or insurance at the time of the alleged offence.
🔘The car has been stolen and you have been sent a fixed charge notice and/or penalty points for offenses committed after the vehicle was stolen.
🔘You no longer own the vehicle
Abnormal causes – Examples of this include:
🔘You broke the speed limit because you are bringing someone to the hospital.
🔘You broke the speed limit because you responded to an emergency at your home (for example, a fire or gas leak).
