Muslim man can register multiple marriages and the Muslim Personal Act allows: The Bombay High Court

Mumbai: The Bombay High Court has said that a Muslim man can register multiple marriages and the Muslim Personal Act allows for more than one marriage. The important judgment of the Bombay High Court was in a case where a Muslim man from Thane sought to register his relationship with his third wife.

The petitioner approached the Thane Municipal Corporation authorities seeking permission to register his third marriage with an Algerian national. But the corporation said that this is the third marriage and it cannot be registered. He approached the High Court against this.

The petitioner requested that the authorities should be instructed to issue the marriage certificate. Under the Maharashtra Marriage Registration Act, a person can register only one marriage. Referring to this, the Corporation authorities rejected the application. But the court stated that according to the Muslim Personal Law, more than one marriage is possible and this has not been considered for marriage registration. The court also pointed out that the authorities of the same corporation had registered the petitioner's second marriage.

But another contention of the corporation was that the applicant had not produced all the required documents. The court directed to produce these documents as soon as possible. The court directed the Thane Corporation to take action as soon as possible after receiving all the documents.
