Supreme Court Hears Pleas Against CEC Gyanesh Kumar Over SIR Decisions

New Delhi—The Supreme Court is hearing petitions challenging the functioning of Chief Election Commissioner Gyanesh Kumar and alleged unilateral decisions taken during the Special Intensive Revision (SIR) of electoral rolls. A bench headed by Chief Justice Surya Kant, along with Justices Joymalya Bagchi and V. Mohana, is hearing the matter today.


The petitions question whether the Chief Election Commissioner can take decisions on behalf of the Election Commission without the concurrence of the other two Election Commissioners. The petitioners have alleged that several decisions, guidelines and software changes related to the SIR exercise were implemented without their approval. They have referred to 14 instances in which Election Commissioners Sukhbir Singh Sandhu and Vivek Joshi allegedly recorded objections between October 2025 and August 2026.

One of the petitions seeks the suspension of Gyanesh Kumar as CEC while the matter is pending. Another seeks the quashing of the 14 decisions and an independent inquiry or Special Investigation Team headed by a retired Supreme Court judge, with experts in cybersecurity and information technology. The petitioners have also sought examination and preservation of the Election Commission's records relating to the SIR exercise.

The Election Commission has maintained that its decisions on the SIR and related Form 6 changes were taken unanimously and have legal backing. The allegations made in the petitions have not been established by the court. The Supreme Court's proceedings today will determine how the court proposes to deal with the petitions and the issues raised before it.
