Srinagar: Before the formation of the government, the Congress is reacting strongly to the BJP's move to nominate five members to the Jammu and Kashmir Legislative Assembly through Lt. Governor Manoj Sinha. They termed the BJP's move as 'anti-democratic'. The BJP's move is pending the results of the 90-member assembly elections in Jammu and Kashmir.
Jammu and Kashmir Pradesh Congress Committee (JKPCC) Vice President Ravinder Sharma said that it is worrying that BJP can nominate five MLAs through the Governor. Voting for the 90-member assembly was held. Waiting for the result on 8th October.
"We thank the people. But the reports that the Lt. Governor is going to nominate five MLAs before the formation of the government are very worrying," said Ravinder Sharma.
He pointed out that the move to nominate five MLAs before forming the government was a strategy of the BJP and was anti-democratic. The Congress leader added that the Congress-National Conference alliance would have a comfortable majority but if the BJP went ahead with the move, it would be an attempt to defeat the mandate and the power to appoint five members should be given to the new government.
Jammu and Kashmir BJP President Ravinder Raina has come to the scene rejecting the Congress arguments. He said the nomination of five MLAs will be in accordance with the provisions of the Jammu and Kashmir Reorganization Act, 2019. He also clarified that what is mentioned in the law will be followed as well. The BJP president added that the Congress knows that they will lose this election and they are disappointed.
Under the Reorganization Act, 2019, the Lt. Governor can nominate two members if the representation of women in the Legislative Assembly is insufficient. Through the 2023 amendment, three more members can be nominated.
With the addition of five members in the 90-member assembly, the strength will be 95. 48 seats are required for absolute majority. Even if it wins 43 seats through popular vote, the BJP can win an absolute majority. Luff is a move to subvert the democratic process. India Alliance and PDP allege that BJP is running through the Governor. They are also taking legal action.
