NIGERIA: Release of sailors hinders India's diplomatic move, complex legal issues; Nigeria toughens position

Nigeria: Complex legal issues hindered India's diplomatic efforts in the case of the seizure of the ship by Nigeria. On August 12, the Heroin Indun ship was seized in Equatorial Guinea under mysterious circumstances. On August 8, Captain Equatorial Guinea was in the custody of the Navy. The next Shipping Company Against Detention of Crews International Tribune The Guinean government handed them over to Nigeria after approaching Lin.

Various Nigerian media have reported that the voyage of the ship, suspected of oil theft and sailing without the national flag, is suspicious. Also, when caught, the ship was diverted and tracking was stopped. And the owners paid $200,000. And the vessel is registered abroad except that there are Indian seafarers. Therefore, the issues that are not enough to interfere with the Indian government are coming out now.

The wives of the crew members have also raised the alarm over the perceived threat to the lives of the Indian crew members in a Save Our Soul (SOS) letter to the Indian Government.

Nigerian Navy said it was aware of “international media campaigns being planned and executed and sponsored by the vessel’s owners/agents, in a bid to muddy the waters and to make false claims of human rights violations against the Nigerian government.”The Very Large Crude Carrier (VLCC), capable of carrying two million barrels of crude oil, has a length of 336 metres, a width of 60 metres, a draught of 11 metres and 299995 metric tonnes and IMO Number: 9858058.

This is coming as 16 Indian sailors, who are part of a multinational crew of 26 sailors of the vessel, MT HEROIC IDUN, detained by Equatorial Guinea’s Navy for three months, have appealed to the Indian Government to help them return home. Diplomatic efforts by the Ministry of External Affairs did not succeed until 89 days later when ship was handed over to Nigeria. So India is keeping a close eye on things.

The arrested ship crews were directly called on the phone and asked for information. The Ministry of External Affairs also stated that it had requested that the investigation be transferred to India or Equatorial Guinea to avoid legal entanglements in Nigeria. The Ministry claims that it has made several interventions through the Embassy in Abuja and the High Commission.

Nigeria is adamant that there should be a legal solution to complaints such as theft of crude oil and violation of maritime boundaries. 26 Heroic Idun ship crew including 3 Malayalis were brought to Nigeria in heavy military encirclement.

They are of the view that the ship should be brought to Nigeria for inspection even though they have paid 20 lakh dollars as fine. The alleged theft of crude oil from the Akpo oil field in Nigeria requires a thorough investigation. The subversion of maritime laws is also to be investigated. It is also mysterious that the ship lost contact with the sub before its capture. Therefore, rather than diplomatic moves, Nigeria's position that the law should follow the law has been a setback.

Apart from this, the shipping company has filed complaints against Nigeria in the Federal Court of Nigeria and the International Tribunal for the Settlement of Maritime Disputes in Germany, alleging illegal detention. This issue also needs to be resolved.
